TERMS AND CONDITIONS OF SALES

 

Earth Water Systems accepts the following credit cards for payment:

MASTERCARD

AMERICAN EXPRESS

PAYPAL

 

PAYMENT TERMS:

Payment is due in accordance with the terms of each invoice. Unless otherwise specified, payment is due in full.  All international orders must be paid by wire transfers only.

 

SHIPPING:

Our products are shipped by independent shipping companies such as UPS, Fed Ex, US Postal or Freight Carrier.  Earth Water Systems has no affiliation with any shipping services. Residential systems are typically shipped within 2-3 days. Delivery time is usually 5-10 business days unless otherwise specified. Earth Water Systems is not responsible or liable for any failure to deliver or delay in shipping that is beyond our control.

 

Large systems such as the whole house systems that are delivered by freight carrier are packed in a heavy duty cartons.  Each carton is cushioned with Styrofoam pads and placed on a specially fabricated wooden pallet and securely strapped with plastic bands that are clamped and stapled to the carton for extra protection. The entire system is wrapped tightly with a plastic film for final protection. If our product is not delivered to you in this precise manner, please do not accept delivery and notify us immediately. Another system will be shipped to you as soon as possible. Upon receipt of your merchandise, please open the carton and check that the contents are in order.

 

CLAIMS POLICY:

Earth Water Systems is not responsible or liable for damaged or loss of merchandise during shipping. 

Make certain that you check merchandise for damage before acceptance by shipping company.

Consignee is responsible for filing a claim for damage or loss with the shipping company.

 

IMPORTANT:

In all cases, we advise customers to note on the bill of lading “that there may be concealed damage”. If the customer does not note the above and there is damage to the merchandise after opening, it will be the customer’s responsibility to file a claim directly with the shipping company. We can then send out the items that you need.

  

RETURNS:

All Sales Are Final. There will be no exchanges unless otherwise noted. Please keep the original boxes, packaging and documentation as delivered. We can only accept a return if it is returned in the original manufacturer’s complete packaging and in perfect condition within 7 days of your receipt of merchandise. We charge a 30% restocking fee for all returns. All returns must be shipped prepaid.

 

Special Orders such as custom whole house systems, commercial and industrial systems are not returnable or refundable.  All filters and membrane are sanitary sealed. Once the sanitary seal is broken, the cartridge or membrane is not returnable. Refunds will not be issued for wet or items that have been wet or submerged.

Any returns must be preceded by a notification by fax to us at (858) 756-0049 before any returns included with those for warranty considerations. Upon receipt of this information, we will contact you for shipping instructions for returns, exchanges and warranty parts.

 

CANCELED ORDERS:

Placed orders but then canceled before the order has been processed are subject to a minimum $100.00 fee. Additional fees may be charged if the system is in the process of being built or if special parts have been ordered. Custom orders are non-cancelable and non-refundable.

 

TECHNICAL SUPPORT:

We provide all of our customers with free professional, courteous and efficient technical support.  All systems come with complete installation procedure.

 

WARRANTY:

The manufacturer warrants on all systems the workmanship for 10 years and five years for media. If within the above period of time, any products shall be defective as assessed by the manufacturer, these products or components will be replaced or repaired at the manufacturer’s option. Seller makes no warranties of any kind, expressed or implied concerning water treatment products offered for sale, including warranties of merchantability or fitness for a particular purpose, except that water treatment

products should be capable of performing as claimed by the manufacturer of each product. Warranty does not cover shipping, labor or installation charges.  We may request that you photograph any damage or warranty claim.

 

THE FOLLOWING CONDITIONS ARE AGREED TO BY THE SELLER AND THE PURCHASER(S):

 

All merchandise shall remain in the name of the Seller until the purchase price is paid in full. Seller shall not be responsible for goods damaged in transit. The Purchaser(s) use and/or installation of above merchandise constitutes acceptance of these legal terms and conditions.  All merchandise is guaranteed only to the extent of the original manufacturer’s warranty.
